In keinem Fall dürfen Mein Shop, unsere Direktoren, leitenden Angestellten, Mitarbeiter, verbundenen Unternehmen, Vertreter, Auftragnehmer, Praktikanten, Lieferanten, Dienstanbieter oder Lizenzgeber für jedwede Verletzungen, Verluste, Ansprüche oder jedwede direkte, indirekte, zufällige, Straf-, Sonder- oder Folgeschäden jeglicher Art, einschließlich, aber nicht beschränkt auf entgangenen Gewinn, entgangenen Umsatz, entgangene Einsparungen, Datenverlust, Wiederbeschaffungskosten oder ähnliche Schäden, unabhängig davon, ob sie auf einem Vertrag, einer unerlaubten Handlung (einschließlich Fahrlässigkeit), einer verschuldensunabhängigen Haftung oder anderweitig beruhen, die sich aus Ihrer Nutzung des Dienstes oder der über den Dienst beschafften Produkte ergeben, haftbar gemacht werden oder für jedwede andere Ansprüche, die in irgendeiner Weise mit Ihrer Nutzung des Dienstes oder eines Produkts in Zusammenhang stehen, einschließlich, aber nicht beschränkt auf Fehler oder Auslassungen in Inhalten oder Verluste oder Schäden jeglicher Art, die aus der Nutzung des Dienstes oder der über den Dienst veröffentlichten, übertragenen oder anderweitig bereitgestellten Inhalte (oder Produkte) entstehen, selbst falls auf deren Möglichkeit hingewiesen wurde. Da in manchen Staaten oder Rechtsräumen der Ausschluss oder die Beschränkung der Haftung für Folge- oder Nebenschäden nicht zulässig ist, ist unsere Haftung in diesen Staaten oder Rechtsräumen auf das gesetzlich zulässige Höchstmaß beschränkt.

ABSCHNITT 14 – SCHADENSERSATZ
Sie verpflichten sich, Mein Shop und unsere Muttergesellschaften, Tochtergesellschaften, Partner, leitenden Angestellten, Geschäftsführer, Vertreter, Auftragnehmer, Lizenzgeber, Dienstleister, Subunternehmer, Lieferanten, Praktikanten und Mitarbeiter schadlos zu halten von allen Ansprüchen und Forderungen Dritter, einschließlich angemessener Anwaltskosten, die aus Ihrem Verstoß gegen diese Servicebedingungen oder die Dokumente, auf die in diesen Servicebedingungen verwiesen wird, oder aus Ihrem Verstoß gegen ein Gesetz oder die Rechte eines Dritten entstehen.

ABSCHNITT 15 – SALVATORISCHE KLAUSEL
Sollte eine Bestimmung dieser allgemeinen Geschäftsbedingungen für gesetzeswidrig, ungültig oder nicht durchsetzbar befunden werden, so ist diese Bestimmung dennoch im größtmöglichen, nach geltendem Recht zulässigen Umfang durchsetzbar und der nicht durchsetzbare Teil gilt als von diesen allgemeinen Geschäftsbedingungen abgetrennt. Eine solche Feststellung hat keinen Einfluss auf die Gültigkeit und Durchsetzbarkeit aller anderen verbleibenden Bestimmungen.

ABSCHNITT 16 – KÜNDIGUNG
Die vor dem Kündigungstermin entstandenen Verpflichtungen und Haftungen der Parteien bleiben für alle Zwecke auch nach der Kündigung dieser Vereinbarung bestehen.
Diese allgemeinen Geschäftsbedingungen gelten bis sie von Ihnen oder uns gekündigt werden. Sie können diese allgemeinen Geschäftsbedingungen jederzeit kündigen, indem Sie uns mitteilen, dass Sie unsere Dienste nicht mehr nutzen möchten, oder wenn Sie die Nutzung unserer Site einstellen.
Wenn Sie nach unserem alleinigen Ermessen gegen eine Bedingung oder Bestimmung dieser allgemeinen Geschäftsbedingungen verstoßen oder wir den Verdacht haben, dass Sie gegen eine Bedingung oder Bestimmung dieser allgemeinen Geschäftsbedingungen verstoßen haben, können wir diese Vereinbarung außerdem jederzeit fristlos kündigen.
